1. Agreement
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
PORTMASTER provides maritime-related information tools (ports, directory features, alerts, admin-managed content, etc.) on an “as is” and “as available” basis. Features may change or be withdrawn. We do not guarantee uninterrupted or error-free operation.
3. Accounts & security
You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or pose security or legal risk. We log authentication events for security and compliance.
4. Acceptable use
You must not misuse the Service, including: attempting unauthorised access, scraping in breach of technical limits, introducing malware, harassing others, or using the Service for unlawful purposes. Directory and user-submitted content must comply with applicable law.
5. Intellectual property
The Service, branding, and original content are protected by intellectual property laws. You receive a limited, revocable licence to use the Service for its intended purpose. You retain rights in content you submit but grant us a licence to host and process it as needed to operate the Service.
6. Third-party data & APIs
The Service may integrate third-party data or APIs (e.g. vessel or port data). That content is subject to third-party terms and accuracy is not warranted. You use such data at your own risk for operational decisions.
7. Disclaimer of warranties
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Maritime operations involve risk; the Service is a tool only and not a substitute for professional navigation, legal, or safety advice.
8. Limitation of liability
To the fullest extent permitted by applicable law (including the Indian Contract Act and consumer protection rules where they apply), we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our aggregate liability arising out of these Terms or the Service shall not exceed the greater of (a) the fees you paid us in the twelve months before the claim or (b) INR 5,000, except where law prohibits such a cap.
9. Indemnity
You will defend and indemnify us against claims arising from your use of the Service, your content, or your breach of these Terms, except to the extent caused by our wilful misconduct.
10. Governing law & disputes
These Terms are governed by the laws of India. Courts at a competent jurisdiction in India shall have exclusive jurisdiction, subject to mandatory consumer or statutory rights that cannot be waived.
11. Changes
We may update these Terms. Continued use after the updated version is posted may constitute acceptance where permitted by law. The version number at the top of this page will change when we make material updates.
